18 Factors That Turn a Bank Debtor into a Bank Victim

The two-month budget report for the year 1400 by the Supreme Audit Court of Iran, indicating the seizure of 1,761 production units by banks, demonstrates the transformation of bank debtors into bank victims. This is an issue that the Supreme Leader warned the officials about in 2015, stating that some banks have destroyed and shut down production units through specific methods.

Therefore, the Task Force for Realizing the Motto of 1400, which is formed under the Provincial Government-Private Sector Dialogue Council with the participation of the National Dialogue Council and other provincial dialogue councils, has initiated a research project to identify the specific methods used by banks. These are the same methods that the Supreme Leader mentioned, leading to the closure of production units.

As this research progresses, 18 topics related to the shutdown of economic enterprises have been identified so far. Three of these were discussed in the 64th session of the Kerman Provincial Government-Private Sector Dialogue Council and are being pursued through the National Dialogue Council. The other topics are also on the agenda for further discussion. The titles of these topics are listed below:

1. Elimination of the graduated penalty in previous contracts.

2. Revival of repurchase regulations.

3. Removal of compound interest from the forbearance directive.

4. Abuse of rights in bank debt collection.

5. Prohibition of transferring loans to overdue status if collateral is sufficient.

6. Prevention of travel bans on guarantors and managers of borrowers.

7. Suspension of additional interest and damages if collateral exists.

8. Adding raw materials and produced goods to exempt assets.

9. Proposal to amend clause 2 of Note 4 of Article 34 of the Registration Law.

10. Proposal to amend clause (b) of Article 19 of the Law on Removing Obstacles to Production.

11. Proposal to amend clause (a) of Article 19 of the Law on Removing Obstacles to Production.

12. Proposal to amend Article 22 of the Law on Removing Obstacles to Production.

13. Proposal to amend Article 32 of the Code of Civil Procedure.

14. Proposal to amend Articles 512 and 505 of the Code of Civil Procedure.

15. Proposal to amend the Law on Facilitating the Granting of Bank Facilities.

16. Proposal to amend Article 23 of the Law on Continuous Improvement of Business Environment.

17. Proposal to amend clause 7 of Article 426 of the Code of Civil Procedure.

18. Proposal to amend Note 1 of Article 15 of the Usury-Free Banking Operations Law.
